Terms of Service

These Terms of Service (the “Terms”) govern your use of the TunedAI mobile app and related services (the “Service”), operated by Eras Partners Inc. (“Eras Partners,” “we,” “us,” or “our”). By installing or using TunedAI, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
TunedAI is an AI-powered audio app that generates podcast episodes from topics you submit. The script, the synthesized voice performance, and the cover art are produced by artificial intelligence models on our behalf. You can play, download, and keep the episodes you generate in your personal library.
TunedAI is not a news service, a journalism platform, an accredited educational institution, or a substitute for professional advice. Episodes are algorithmically generated for entertainment, exploration, and personal interest.
2. Eligibility
You must be at least 18 years old to use TunedAI. By accessing or using the Service, you represent and warrant that:
- you are at least 18 years old;
- you have the legal capacity to enter into these Terms;
- you are not prohibited from using the Service under applicable law; and
- your use of the Service complies with these Terms.
3. Subscription, billing, and cancellation
TunedAI offers a paid subscription (“Premium”). The current price, billing period, and any introductory offer (such as a free trial) are shown in the App Store before you confirm purchase. By subscribing, you agree to the following:
- Payment is charged to your Apple ID at confirmation of purchase, and at the end of any introductory or free-trial period if you do not cancel before it ends.
- Your subscription automatically renews at the then-current price for the same billing period unless you cancel at least 24 hours before the end of the current period.
- You can cancel at any time in iOS Settings > your name > Subscriptions > TunedAI. Cancellation takes effect at the end of the current billing period.
- Refunds, where available, are handled by Apple under the App Store’s standard terms.
If you do not subscribe, you can use the Service under the free tier, which offers a limited number of episodes and scheduling options. The free tier’s limits may change.
4. Acceptable use
You agree not to use the Service to generate, share, or do any of the following:
- content that infringes anyone’s intellectual property, privacy, or publicity rights;
- content that depicts or sexualizes minors, or otherwise exploits children;
- content that promotes violence, terrorism, self-harm, hate, or discrimination against a protected group;
- content that impersonates a real person without their consent, or attempts to clone a real person’s voice;
- disinformation about elections, public health, or other matters of public concern;
- malware, phishing content, or anything designed to harm others;
- scrape, harvest, or otherwise extract data from the Service by automated means;
- use episodes, scripts, or voice output to train, fine-tune, evaluate, or otherwise develop competing AI models;
- reverse-engineer, decompile, or attempt to derive the source code of the Service;
- circumvent rate limits, quotas, paywalls, or other technical restrictions;
- misrepresent AI-generated content as original human authorship for commercial gain;
- any activity that violates applicable law in your jurisdiction.
We may filter, refuse to generate, remove, or take other action against any content or account that breaks these rules.
5. AI-generated content
Episodes are produced by AI models and may contain errors, omissions, inaccuracies, hallucinations, biases, or content that is offensive or factually wrong. AI models can produce material that is unintentionally similar to existing copyrighted works. We make no representations or warranties about the originality, accuracy, copyright status, or fitness of any generated episode. You are solely responsible for reviewing what you generate before sharing it.
6. No professional advice
Episodes are produced for personal interest and entertainment only. TunedAI does not provide medical, mental-health, legal, financial, tax, investment, career, academic, or other professional advice. You agree that:
- you will not rely on episodes for any decision with medical, legal, financial, or otherwise consequential implications;
- TunedAI is not responsible for outcomes resulting from acts, omissions, or decisions made in reliance on the Service;
- you will consult qualified professionals when appropriate.
7. Your inputs, generated episodes, and ownership
Your inputs. You retain ownership of the topics, format choices, language preferences, and other inputs you submit (“Inputs”). You are responsible for ensuring you have all necessary rights to submit them and that they comply with these Terms. By submitting Inputs, you grant us a limited, worldwide, royalty-free license to host, store, process, and transform them solely to generate the episode you requested, deliver it to you, and keep it available in your library. This license ends when you delete the corresponding Input or episode.
Generated episodes. Subject to these Terms, we grant you a worldwide, non-exclusive, non-transferable, revocable license to play, download, and share the episodes you generate (“Generated Output”) for personal, non-commercial use only. Generated Output is licensed, not sold.
Commercial use is not permitted without our prior written authorization. Commercial use includes, but is not limited to:
- publishing episodes on monetized podcast platforms, video channels, or streaming services;
- selling, licensing, or otherwise monetizing Generated Output in any form;
- incorporating Generated Output into paid courses, training programs, or coaching materials;
- using Generated Output in advertising, marketing, or promotional materials for any product or service;
- distributing Generated Output as part of any revenue-generating activity.
TunedAI and its licensors retain all right, title, and interest in and to the AI models, algorithms, software, and other technology used to produce Generated Output.
8. Third-party services
TunedAI relies on third-party AI models and cloud infrastructure providers to produce and deliver episodes. Your use of the Service is also subject to the relevant terms of those providers where they apply to user-submitted content.
9. Beta and experimental features
From time to time, TunedAI may make experimental, preview, or beta features available. These features are provided “as-is,” may behave differently from standard features, may produce unexpected results, and may be modified or discontinued at any time. Your use of beta features is voluntary and at your own risk.
10. Copyright complaints (DMCA)
We respect the intellectual property rights of others. If you believe content on the Service infringes your copyright, you may send a notice under the Digital Millennium Copyright Act to support@tunedai.app. Your notice should include:
- your physical or electronic signature;
- identification of the copyrighted work you claim has been infringed;
- identification of the material you claim is infringing, with enough detail for us to locate it;
- your contact information (address, phone number, email);
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
- a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner.
We may remove or disable access to allegedly infringing material upon receipt of a valid notice. If the affected user submits a valid counter-notification, we may restore the content unless the copyright owner initiates legal action within the timeframe required by law. We may terminate accounts of repeat infringers.
11. Disclaimer of warranties
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that AI-generated content will meet your expectations. Some jurisdictions do not allow exclusions of implied warranties; in such cases, these limitations apply to the fullest extent allowed by law.
12. Limitation of liability
To the maximum extent permitted by law, in no event will TunedAI, its directors, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) US $50. Some jurisdictions limit liability exclusions; these apply to the fullest permissible extent.
13. Indemnification
You agree to defend, indemnify, and hold harmless TunedAI, its officers, directors, employees, and contractors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
- your misuse of the Service;
- your violation of these Terms or any applicable law;
- Inputs you submit that infringe a third party’s rights or violate any law; or
- any commercial use of Generated Output in violation of Section 7.
14. Termination
You can stop using the Service at any time by deleting the app and, if you have an active subscription, cancelling it through Apple. We may suspend or terminate your access if you violate these Terms or use the Service in a way that risks harm to us, other users, or third parties. On termination, your right to use the Service ends; sections that by their nature should survive (including Sections 5, 6, 7, 11, 12, 13, and 18) will survive.
15. Changes to the Service or these Terms
We may change the Service’s features, pricing, free-tier limits, or these Terms from time to time. If we make a material change to these Terms, we will post the new version with an updated “Last updated” date and, where appropriate, notify you in the app. Continuing to use the Service after a change means you accept the new Terms.
16. Governing law and disputes
These Terms are governed by the laws applicable at the operator’s principal place of business, without regard to conflict-of-laws principles. You agree that any dispute arising from these Terms or the Service will be resolved exclusively in the competent courts of that jurisdiction, except where mandatory consumer-protection law in your country of residence requires otherwise.
17. Apple’s standard EULA
The Service is licensed, not sold. To the extent we have not provided our own end-user license agreement, Apple’s standard licensed application end-user license agreement applies and is available at apple.com/legal/internet-services/itunes/dev/stdeula.
18. Entire agreement and severability
These Terms, together with our Privacy Policy, constitute the entire agreement between you and TunedAI regarding the Service and supersede any prior agreements. If any provision is found unenforceable, that provision will be limited or struck only to the extent necessary, and the remaining provisions will remain in full force. Our failure to enforce any right or provision is not a waiver of that right or provision.
